On 25th May 2018, the EU GDPR comes into effect; and it’s here to stay well beyond Brexit. This significant legislation will succeed the Data Protection Act 1998 (DPA), and is described by some as the “biggest single shake up of data legislation in the last 25 years.” It will have wide reaching affects for all organisations who collect, manage, process, and store personally identifiable and sensitive data for EU citizens — anywhere in the world.
The GDPR will be a board-level accountability, with requirements for clear governance and reporting to ensure compliance. The consequences for organisations that fail to demonstrate compliance and are found in breach of the regulation risk facing financial penalties of up to €20 million or 4% of an organisation’s global turnover, whichever is the greater, criminal prosecution, in addition to damage to reputation.
